General terms and conditions

These Terms and Conditions (“Terms”, “Terms”) govern your relationship with the mobile Progression application (the “Service”) operated by devpie (“us”, “we” or “our”).

Please read these Terms and Conditions carefully before using Progression (the “App”).

Your access to and use of the Service is subject to your acceptance and compliance with these Terms. These terms apply to all users. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.

Subscriptions

Some parts of the service are billed on a subscription basis (“subscription(s)”). Billing is done in advance on a recurring and periodic basis (“billing cycle”). Billing cycles are set on either a monthly or annual basis, depending on the type of subscription you choose when purchasing a subscription. At the end of each billing cycle, your subscription will automatically renew on exactly the same terms, unless you terminate it or devpie terminates it. You can cancel your subscription renewal through Apple Account Preferences.

Changing fees

devpie may at its sole discretion and at any time change the subscription fees for the subscriptions. Any change in the subscription fee will take effect at the end of the current billing cycle.

devpie will provide you with reasonable notice of any change in subscription fees so that you can cancel your subscription before such change takes effect.

Your continued use of the Service after the effective date of the Subscription Fee Amendment constitutes your acceptance of payment of the revised Subscription Fee Amount.

Refunds

Subscription fees paid will not be refunded unless required by law.

Intellectual Property

The Service and its original content, functions and features are and shall remain the exclusive property of devpie and its licensors. The Service is protected by domestic and foreign copyright, trademark and other laws. Our trademarks and trade dress may not be used in connection with products or services without the prior written consent of devpie.

Links to other websites

Our app may contain links to third-party websites or services that are not owned or controlled by devpie. devpie has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party website or service. You further acknowledge and agree that decpie shall not be responsible or liable, directly or indirectly, for any damages or losses caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly encourage you to read the terms and conditions and privacy policies of any third party websites or services that you visit.

Limitation of Liability

In no event will devpie or its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to lost profits, data, use, goodwill or other intangible losses, arising out of (i) your access to or use of, or inability to use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any Content obtained from the Service; and (iv) unauthorised Content.
